Hi,
I tried to search for this and could not find anything.
When dealing with 485 portability using EAD (with approved I140),
what happens if your underlying LC is a location/region/state bound and you end up moving to out of that specified region.
Job duties/job code can stay similar with probably salary increase.
Does the location violation get equated to unequal/dissimilar job duties resulting in 485 denial?
Chances are that should I have to invoke AC21 portability(due to layoff or something alike), I'll be facing this so I just want to be prepared for possibilities.
Thanks for insights.
NS
PS: In other words: What will be considered violation or conditions for Similar job duties if job title and responsibilities stay same but other factors - i.e employer, location, salary cap changes.

Hi Guys-
I am on H1B, working in US. I got my status changed from F1 to H1B last yr and never got it stamped ever since. I am going to get married next month in India and would require a visa stamp on my passport. I believe it is a straight forward process but would appreciate your experiences and suggestions for this.
1. I am planning to take visa appointments both for myself and my future wife togther at the Delhi consulate (ofcourse by paying separate fee). Can I do that here in US for both of us?
2. Once I get an appointment, we both should appear togther for the interview (for my H1B and her H4) . Right?
3. The forms 156 and 157 are required to be filled during the interview but not while taking appointments. Is it right?
3. I will take all my docs. along with our marriage certificate, and pictures from wedding. Do I need something extra to that?
Please suggest me any other important thing which I should be aware of in this process.
Thanks much!:)

Not surprising, but surprising that Luis would admit it. And if this is the case (and I think it is), then the question is whether we wait until 2011 or later to push again or finally decide it's time to look at other strategies like piecemeal reform (pass DREAM, AgJobs, legal immigration reform now and deal with legalization later) or look at administrative actions like TPS or parole and a moratorium on deportations for people who would otherwise meet the requirements of a proposed legalization program.

I am on L1B visa from Apr 2008. I have my PERM and I140 approved.
I got a email from my attorney stating that they want to file my H1B petition this year so that they can keep on renewing my H1b as long as my company wants.
Suppose they file H1B COS petition then my status will automatically change on Oct 1 2010.
I am planning a vacation to India in November 2010, what are the options with me when come back to US.
- Do i have to stamp the H1B visa OR
- I can still come back on my existing L1B visa ???
Please suggest
Thanks

If you care about America's ability to compete in the years to come, you know that having a robust, well-functioning talent worker visa system is critical. One group with a great track record for work on creating such a system is Immigration Voice. They're sponsoring Immigration Voice Advocacy Days June 7th and 8th in Washington and I urge all readers able to participate to please do so. IV has nearly 400 meetings scheduled with members of Congress and the Obama Administration and this is a great opportunity to have your opinions heard by people who can make a major difference...

Hi,
I was on H1 VISA when my wife came here on H4 VISA. When I was filled her DS-157 form for H4 Stamping by mistake I put the wrong dates of employment.
Now she got her H1 Visa approved when she was here in US. She is going for H1 Visa stamping . She is filling her DS-157 again with the correct dates. Would it be a problem. Would H4 DS-157 be tied back to DS-157 for H1 while she is there for H1 Stamping.
Please any help would be appreciated.

I hear from multiple sources that a concurrently filed 485/140 with 140 in premium is the fastest way to process.
Does this make sense ?
It could be as 485 does not have a A number till 140 is approved.
Once 140 is approved, then have to open the corresponding 485 and enter that information and proceed with its processing ????
So I believe this one is faster than even the approved 140 case submission of 485 ?
Any comments ?
Does anyone have insight or more info on this.
I just want to know if 485 filed with 140 approved is faster or slower than filing 140PP/485 concurrently ???

My EAD got approved today. It is in card production stage.
I am wondering if mutli year EAD if effective immediately. If so, I will be getting EAD that is valid for 3 yrs or mutli years right?
Friends, I appreciates your inputs.

Gurus,
Need your help. Can I ask my employer to file a new perm labor processing while I am on EAD status (pending my existing case)?
Idea is to do EB3- EB2 porting with a perm. I heard you can file Perm only if you are on H1 or other status and not on EAD (AOS Pending I485).

Basically everyone has experienced at least one version of the Falling Snow tutorial It just so happens that you can see the progress that ActionScript has made as a language as well as the progress that Kirupa has made in making tutorials. :trout:
I went with the 2.0-style snow because it translates best into shirt form. Enjoy!

And the purge continues... First Minutemen founder Chris Simcox goes after John McCain. From Politico: A co-founder of the anti-immigration Minutemen on Monday dismissed Sen. John McCains new, tougher immigration stance as 'shameful election-year politics.' The Arizona Republican, whos seeking a fifth term this fall, is now supporting an Arizona bill that allows law enforcement officers to demand proof of citizenship even if they just suspect illegal status and detain suspects until the federal authorities can determine their citizenship. McCains move, announced Monday, is a dramatic shift right from his more moderate, comprehensive approach to most immigration issues....
