The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. Crist will likely not appoint himself and a number of names are circulating for potential replacements. According to Politico, one person being considered is Jacksonville-area State Representative Jennifer Carroll. Carroll would be the first black female Republican Senator if she were selected. I will start working Jan/2007 as OPT. The company will apply H-1b for me after April.1st. At the same time, I also apply for phd program and I am not sure if I can get school offer. I believe I will know the result of phd application before the H-1b gets approved.
My question is:
If I get school offer, I know it is easy to cancel H-1b but how to cancel change of status? what is my status after I leave the company and before I go to school? what do I need to do to keep OPT until enrollment?

You can extend status while living at US, but for re-entry after international travel (after November 26, 2009) you must get the visa stamped on your passport.

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.I also heard same thing but talking to a attorney is good than posting here..

I know many friends of mine, who has done B.E and MS from diferent background (like Mechanical, Electronics etc) and were still able to get the LC approved from a software company since they were working there. There should not be any issue with it.

I am on h1-b since Oct 1, 2004. I am EB3-ROW (Rest of World). My company has filed I-140 in June 2006 and it has not been approved yet. How soon would I be able to change jobs? I'm about to finish my master's degree and am hoping to get a job that falls in either eb-2 or eb3 category. How will this impact the ability to keep my i-140. Would i have to start from scratch with my new employer if i find a new job?
Also what is considered my priority date since I havent/cant file an i-485 yet.

Hi,
Here is my situation.
During the july fiasco last year, I applied for I-485 through Company A(I am still working for it). My I-140 is approved. PD : Aug, 2006, EB-2
At the same time, another company (Company B) applied for I-140 through labor substitution(PD: Nov, 2005, EB-2) and it got approved in May this year. I have a receipt notice of that application but no copy of approval notice. I dont intend to join Company B and dont expect any support from them.
Now that PD is June 1, 2006 for EB-2, is there any way I can use the PD of Company B with out the approval notice? If so, can someone point me to the right direction. Thank you.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

I have been an active donor but had to temporarily cancel my subscription due to pay pal problems. I am back donating again and cannot access the donor forums. Could you please help me with this issue? I tried writing on the 'Contact us' form, but havent had any luck so far.

She applied for medical residency and the programs she got calls for are sponsoring J1 visas only. I have a phd from US university and applying for EB1 OR through a semi conductor company anyway.
I am in dilemma whether to apply for EAD for my wife or let her go on J1. J1 has implications later for medicine students but given the randomness of USCIS, I am never sure when eb2 date would be 11/2007 for eb2 485 or denial of eb1 or application.
Please advise me over this dilemma.

One of my friends has been unemployed for the last 6 months but his AP and EAD are current. He needs to go to India in June. Will he face any problems while coming back into the country? Should he postpone his India trip till he he has been on a job for 3-4 months? If he starts his own company and gets a salary from that will it cause problems? Also Newark is his closest airport. Is Newark OK for AP or should he try Philadelphia or JFK in New York?

I know that most of the people on this forum are EB filers. However, for the few stragglers here who are filing in the family based category, please share your experience on filing the I-751 (petition to remove the condition on the GC). Specifically, I'd like to know the following:
- Estimated time from filing date to receipt of permanent GC
- Did you have interview with USCIS?
- Compare / contrast with first interview during the AOS process.
